another decision of THE MODI government under scanner by the opposition !
I have always wondered about the provision of freedom of speech
and its misuse by people sitting at responsible positions. However, off late
the irrespensibility has gone one notch up to put them in the category of being
called fools who eat their own shit at the end of the day, interestingly ,
trapped in their own logics !
In line of fire is the newly appointed governor of Kerala, the
ex Chief Justice of India
Let's look at the statements coming from various quarters and
counter them then and there
1. This move has been
unprecedented in independent India. Kerala Pradesh Congress Committee, VM
Sudheeran
Sir, the country has been ruled by your party for 60 years, that
however does not make it a legal binding for new non cong govts to follow the
set precedence for everything they do. If Cong govts were corrupt, you cant cry
foul, why is the new govt not being, its unprecedented !! Anything donw within
the legal framework doesnt need to be ratified by the Cong, before
implemenation
2. Chandy reportedly said that during his tenure as a
chief minister, whenever a new governor was appointed, he was consulted, but
not this time.
Excuse me Sir... Rather Thank You Sir, for being honest enough
to have accepted the fact. But can your ex home ministers and others
responsible for appointments vouch they did the same for the non Cong ruled
states as well?? Did they respect state govts decision on appointments of
governor? Let's not go too far, just precisely, did Kamla Beniwal enjoy Gujarat
government's support?
3. This is purely a political appointment and earlier, the
Law commission of India had also recommended that no retired high court or Apex
court judge should accept such political posts,” Justice GB Patnaik (Retd).
While it is in fashion for the retired people to do things to
remain in limelight, what they forget is it more often than not lowers their
own dignity !
A retd judge calls it a political appointment forgetting that
the apex court verdict refers to governor as a
constitutional post and hence has more than once recommended new governments coming into power, not to
remove the existing governors ! If interpretation of an ex judge is so wrong,
then god save the nation ! Or if he has the conviction of it being a political
posting, then why not move a revision petition against Apex court’s order, that restrict the central governments
to play with the post?
4. Seetaram Yechury also echoed similar sentiments and went on
to add that such things hadn’t happened in the past because it could have
appeared to be affecting the independence of the judiciary.
Mr Yechury , it is the right age for you to call for retirement
from public life before your memory starts deceiving you more often !
(a) Are their not 100s of example os people at high posts having
been given Rajya Sabha Nominations? Is that ethical?? Could it be believed that
, those were not paybacks for favours taken from them during their postings??
(b) Pinpointing to the governor issue, you say it is
unprecedented ? Let me remind you, Justice Fathima Beevi, the first
woman judge of the Supreme Court was subsequently appointed as the governor of
Tamil Nadu. Now put your shoe in the mouth and shut up !
Coming back to the point of responsible opposition and freedom
of speech, the country would do better with Dumbheads keeping mum and
destructive mentalities looking for better job than misusing the fundamental
laws of the constitution
